These Terms of Service (“Terms”) govern your access to and use of Fauna Academy services (“Services”), provided by Fauna Digital LLC (“Fauna”, “we”, “our”, or “us”). By purchasing, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not purchase or use the Services.
Fauna Academy provides a managed learning platform based on Moodle, including hosting, configuration, basic branding, and support as described on our website. We provide the platform infrastructure and setup. You are responsible for providing your training content (including, but not limited to, videos, PDFs, presentations, and SCORM packages).
Services are sold as annual subscriptions unless otherwise stated. Subscription fees are billed in advance for the subscription period. Payments are processed through Stripe or other authorized payment providers.
We aim to deliver a standard platform setup within two business days after receiving your onboarding information (logo, brand colors, domain or subdomain preference, and admin details). Delivery timelines may vary for complex requirements, domain configuration delays, or custom development requests.
You agree not to use the Services for unlawful activities or to upload content that is illegal, infringing, abusive, harmful, or malicious. You may not attempt to disrupt, damage, or gain unauthorized access to our systems, servers, or networks. We may suspend or terminate Services if we reasonably believe you are violating these Terms.
Basic support is provided via email Monday through Friday during business hours (Eastern Time), excluding holidays. Basic support includes platform availability incidents, access assistance, and general guidance. We provide a first response within one business day. Resolution timelines depend on complexity and third-party dependencies. Optional paid add-ons may provide faster response times and expanded support scope.
Custom plugins, integrations, reporting, and additional development services are not included unless explicitly purchased. Custom work may require separate agreements, scope definition, and timelines.
You retain ownership of your content. You grant Fauna the right to host and process your content solely to provide the Services. You are responsible for ensuring you have all necessary rights to upload and use your content on the platform.
We use reasonable measures to maintain service availability and data integrity. However, no online service can be guaranteed to be uninterrupted or error-free. We may perform maintenance, updates, or emergency interventions as needed.
We offer a seven-day money-back guarantee when requested within seven days of purchase. Refunds may not apply if custom branding has been delivered, significant setup work has been completed, or custom development has started. Approved refunds will be processed to the original payment method.
You may choose not to renew your subscription at the end of the subscription period. If a subscription is not renewed, access to the Services may be suspended and data may be removed after a reasonable retention period.
To the maximum extent permitted by law, Fauna will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, arising from your use of the Services. Our total liability for any claim will not exceed the amount paid by you for the Services during the twelve months preceding the claim.
We may update these Terms from time to time. Updated Terms will be posted on our website with a revised “Last updated” date. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles.
